Dear Operator:
At the March 17, 2003 meeting of City Council, a motion was passed requiring that a letter be sent to vendors or providers of adult magazines seeking their cooperation in restricting the display and sale of such magazines. Council’s objective in pursuing this initiative is to protect children from magazines which are unsuitable for their age.
Adult magazine includes a magazine designed to appeal to erotic or sexual appetites or inclinations, and which is inappropriate for children under 18 years of age to view. Such magazines are pornographic in nature in that they depict images of nudity. Examples of adult magazines include, Penthouse, Playboy, Hustler, etc.
In accordance with the Council motion, this letter is being sent to you with the request that you voluntarily comply with the following standards:
1. All adult magazines offered for sale or display shall be placed behind the front counter in the business premises.
2. All adult magazines offered for sale or display shall be placed behind an opaque barrier to ensure the covers of the magazines, except for the name, may not be seen by any member of the public.
3. No adult magazine shall be viewed by or sold to a minor.
The effectiveness of this “good will” approach will be measured by the level of compliance by business operators with the above standards for adult magazines. If business operators do not voluntarily comply with the standards described above, the City may consider enacting a bylaw to regulate the sale and display of adult magazines. The level of compliance with these standards will be considered by Council in deciding whether or not a bylaw should be passed. This good will approach will be effective May 20, 2003.
Lastly, you may be selling magazines which are not adult magzines as described above but which contain content designed for persons 18 years of age or older. In a further effort to protect children from unsuitable materials, Council asks for your cooperation by taking reasonable steps to control the display of such magazines in your store.
